Booking Procedure 1. Make sure you have read the appropriate Course Details or Expedition Information Pack for your booking. 2. Read our Terms and Conditions click here 3. These terms are to regulate booking conditions and other issues between you and us relating to our Services. By using our Web Site in any way or by availing our Services, you agree to be bound by them.
No person under the age of 18 years can make a booking for our Services. Booking on certain Trips (as per our discretion) can be made for persons under the age of 18 years by their parents with accompanying written consent of the parents.
1 Definitions In this document: “Course” means any pre-organised course in Western Europe or custom guiding in Western Europe. “Expedition” means any tour outside Western Europe as may be organised from time to time. “Information Pack” means the information about the Trips as most recently posted over the Web Site and includes emails, correspondence for custom guiding, etc. “Price” means the price as defined in paragraph 3.1. “Start date” means the proposed date for starting of the Trip as per its Information Pack. “Trip(s)” means holiday trips, the Courses, the Expeditions, custom guiding and adventurous sports as described over the Web Site. “we/us/our” refers to Dream Guides Ltd, company no.6018508, registered in England and Wales. Registered address: Llamedos, Eaudyke, Friskney PE22 8RT, UK. “Web Site” means www.dream-guides.com “you/your” means any visitor to the site and includes any person making a booking.
2 Booking Procedure
2.1 Your booking for the Trip is subject to our approval on the basis of checking all your particulars in the booking form and realisation of required money. Your booking will be confirmed within 10 days after your request via e-mail or post. Making your booking implies that you understand and accept these terms and agree to abide by them. You also agree that you have read and understood the appropriate Information Pack before booking. 2.2 An advance of £400 per person per Course is payable with booking for the Course and the balance will be paid at least 30 days before the Start date. In case the booking is requested within 30 days before the Start date or the Price for the Course is less than £400, full Price will be payable with the booking. 2.3 The price in case of bookings for Expeditions is to be paid as follows:
3 Price and Payment
3.1 The Price for the Trip will be as per the Information Pack or as agreed by email for custom guiding. 3.2 On receipt of your booking form, we will raise a payment request via e-mail for the Price. You can pay in any one of the following options:
3.3 Prices are based on exchange rates, taxes, fees and transport costs at September 2005. The Prices can be revised by an increase or decrease in the event that these rates change considerably. In case of any such revision:
3.4 Expedition prices are accurate for the minimum number of persons at a maximum guiding ratio as stated in the relevant Information Pack. We reserve the right to cancel an Expedition if the minimum numbers are not reached, or increase the price to cover the additional expense incurred. We will do so no later than 2 calendar months before the Start date. If you choose to cancel the Expedition booking due to the increased Price, your advance payment shall be forfeited and you will further be liable for an additional sum to cover the expenses incurred by us.
4 Your obligations during the Trip
4.1 During the Trip, you will follow all legitimate instructions and decisions of the person leading the Trip. You can be excluded from the Trip due to your ill-heath, safety or you compromising the success and enjoyment of other Trip members, without any refund. If you contravene the decisions or advice of your guide, or undertake independent mountain activities during the Trip, it will terminate all protection and duty of care from us. If you voluntarily leave a Trip early you will be responsible for any costs incurred and you agree to relinquish the guide of any duty of care. 4.2 In case of the Expeditions to remote areas lacking formal rescue and healthcare facilities, you may be asked to agree to a mutual medical consent form whereby you agree to providing and receiving medical treatment from the guide or other team members in case of accident or illness, whilst evacuation plans are put into effect. Although you do not have to give consent to such an arrangement, if we believe that in doing so your own safety or that of others may be compromised during the Expedition, we reserve the right to cancel your booking with a full refund.
5 Cancellation and transfer
5.1 The booking can be cancelled under the following grounds:
5.2 Where we have cancelled/postponed/transferred any Course due to insufficient number, you will be given a notice of not less than 21 days before the Start date. You would have the option to go for free transfer; or full refund; or to any other mutually agreed alternative arrangement. Your decision has to be communicated as soon as possible via e-mail. 5.3 In the interest of your safety, changes may occur to both travel and guiding itineraries due to the factors beyond our control such as; bad weather and mountain conditions etc. 5.4 You can request for the transfer of your booking of a Course at any time before 42 days from the Start date. Your request will be accepted on the availability of the requested alternate and payment of £25 as administration fee. Your Course booking is also transferable in favour of another person (subject to a notice of 15 days) who satisfies all desired conditions including health, fitness and others specified for the Trip and agrees in writing to comply with all terms of this document. 5.5 You can cancel your booking by giving us notice by post or e-mail at any time. Due to such cancellation, the advance deposit will be forfeited where notice of cancellation is served at least 1 month before the Start Date in case of the Course and at least 3 months before the Start Date in case of the Expedition. In all other cases, full Price will be forfeited.
6 Insurance
You are required to have specialist mountaineering insurance covering helicopter rescue, medical treatment and repatriation and on/off piste skiing for ski courses, for all the Trips taking place outside the United Kingdom in addition to cover for any loss arising due to the cancellation of the Trip. We reserve the right to cancel your booking at any time if we are not satisfied that you have an adequate insurance policy to cover all such risks. You must bring all insurance documentation with you on the Trip.
7 Risk
Whilst we maintain high professional standards of care and safety, you must realise and accept that climbing, mountaineering and skiing are strenuous activities that take place in remote and hazardous mountain terrain, where there is a risk of accident, injury and death. You must be aware that taking part in such activities involves an acceptance of objective risks and taking responsibility for your own actions. We can not be made liable for any injury, illness or death of any person on the Trip in any case.
8 Limitation of Liability
We will not be liable for the breach of these terms or any tortious act or cancellation/curtailment of any Trip in consequence of strikes, riots, acts of war or terrorism, disease outbreaks, government intervention, natural disasters, adverse weather conditions and other causes beyond our reasonable control which may include but are not limited to deficiency of services by third party which have been hired for the Trip. On such occurrences, we, at our sole discretion will offer an alternative holiday if possible, but will be never liable for return of any money paid prior to such occurrence. We do not guarantee success, in terms of summits obtained or ski descents made on any given Course or Expedition. Medical advice or treatment given by any doctor or guide on our behalf is done in good faith without liability.
9 Indemnity
You shall indemnify us for any damages including legal expenses arising out of third party claims which may be caused due to your act, omission or negligence, deliberate or otherwise during the Trip.
10 Data Protection
For the purpose of Data Protection Act, 1998 you consent to the processing of all or any personal data (in manual, electronic or any other form). Processing includes but is not limited to obtaining, recording, using and holding data and includes transfer of data to any country either inside or outside EEA.
11 Rights of third party
Nothing in this document or on the Web Site will confer any third party any benefit under the provisions of the Contracts (Right of Third Parties) Act, 1999.
12 Disclaimer
12.1 All information contained on the Web Site, Information Packs and other publicity is for guidance only. We have taken every effort to ensure accuracy and will not be responsible for any inaccuracies or alterations beyond our control. Should any changes occur, you will be notified as soon as possible 12.2 All information in Information Packs is as accurate as possible. However, due to the complexities of organising any Trip some details may change. You will be notified of any changes as soon as possible. 12.3 If the named guide(s) is not available for any given Trip or has to be changed, you will be notified as soon as possible. We are not responsible as to the quality and standard of any services provided by third party, engaged for the Trip such as accommodation, transportation and food provided during the Trip even after taking all reasonable efforts.
13 Dispute Resolution
In the event of any dispute arising out of or in consequence with these terms or on or after the Trip, then you agree to attempt to settle the dispute by engaging in good faith with us in a process of mediation before commencing arbitration or litigation. Only Mr. Guy Willett (Director of Dream Guides Ltd) and Mr. Kenton Cool (Director of Dream Guides Ltd) have the authority to settle the case for this purpose by offering a refund or any alternative compensation on behalf of us as per these terms.
14 Jurisdiction
These terms will be interpreted in accordance with the laws of England and will be subject to the jurisdiction of the English courts.
